Terms of Use - Ctuit Communtiy

Welcome to the Ctuit Community! By joining this community, You agree that You will comply with these Terms of Use. We reserve the right to modify these Terms of Use at any time, and Your use of the community constitutes Your agreement to comply with the most recent modification of these terms.

Access and Account

Access to the Ctuit Community will be provided to You per this agreement. The community may be provided through a third-party service provider for some or all elements of the Ctuit Community. In accessing the community, You are granting Us the right to share necessary information with Our third-party service provider, and accept that You will be required to establish a username with Our third-party service provider.

Your profile must contain accurate information. Your username or any other profile information may not: (i) belong to someone else, (ii) impersonate another person, (iii) be misleading, (iv) violate any intellectual property or other proprietary rights, (v) contain vulgar or offensive language, (vi) use “Ctuit” in any way unless We provide express permission to do so. We reserve the right to reject any profile or username at Our discretion.

Your Conduct and Responsibilities

Your conduct within the community must comply with this agreement, as well as the following:

1. Community Members must comply with:
   1. Ctuit RADAR Subscription Agreement, found under the “Account” tab in Ctuit RADAR.
   2. Community Participation Guidelines, found in the Community under “Community Guidelines” in the “Getting Started” category.
2. Community Moderators must comply with the Community Member requirements set forth above, as well as
3. Community Moderation Guidelines, found in the Community under “Moderation Guidelines” in the “Getting Started” category.

The community is a place for Ctuit users, partners, and employees to learn from one another by sharing their product knowledge and best practices. We will also work with customers directly on how to enhance Our products to better serve their needs. To preserve this environment, Your responsibilities within the community are as follows:

You shall:

• Treat other Ctuit Community members with courtesy and respect;
• Comply with these Terms of Use as well as the other referenced policies set forth in this agreement;
• Make reasonable efforts to prevent unauthorized access and unauthorized users from accessing the community, and to notify Ctuit promptly of any unauthorized access or use; and
• Participate in a manner that is in compliance with these Terms for its intended purpose, and in compliance with all applicable laws and government regulations.

You shall not:

• Impersonate another person or company;
• Submit content in exchange for payment or other consideration from another person or entity;
• Make the Ctuit Community available to any other person, including the sale, resale, rent, or lease of the Ctuit Community;
• Use the Ctuit Community in a manner that provides unsolicited commercial messages, or to promote third-party products or services;
• Violate any anti-spam or similar law;
• Publish, post, upload, or otherwise distribute any material protected by intellectual property laws or rights of privacy or publicity without express rights and consent to do so;
• Store or transmit malicious code or malware, or engage in phishing or other fraudulent activity;
• Attempt to collect information about others – including e-mail addresses – without their consent
• Post or provide links to any content that:
  • Infringes or violates any intellectual property or other rights of any person or entity;
  • Restricts, inhibits, damages, disables, overburdens, or impairs any Ctuit Community members from using and enjoying the community or any other Ctuit product;
  • Violates anyone’s privacy or publicity rights;
  • Breaches any confidentiality agreements that you owe to anyone;
  • Provides or otherwise distributes confidential, proprietary, or sensitive information;
  • Is, in Our sole discretion, deemed to contain vulgar, offensive, inappropriate, harassing, defamatory, abusive, lewd, pornographic, obscene, or otherwise objectionable;
  • Contains or installs any viruses, worms, bugs, Trojan horses, malware, or other code, files, or programs that have the capability to disrupt, damage, or limit the functionality of any software or hardware; or
  • Contains false, deceptive, misleading, or fraudulent language; unsubstantiated or comparative claims regarding Our or others’ products; advertising, commercial referrals, spam, chain letters, or any other solicitation, including solicitation of lawsuits.

Please remember that the content provided by You in the community is for an international audience. Things that may not seem to be abusive, obscene, or offensive to You might seem so to others within the community.

You are solely responsible for maintaining compliance with any and all policies set forth in Your employer’s policies and requirements. You are responsible for compliance with any regulatory or legal requirements that You may be subject to as a result of Your employment, residence, or role within an organization.

Your usage of the Ctuit Community is at Your sole risk. We may modify the functionality and/or interface of the Ctuit Community at any time at Our sole discretion, and such modifications may result in a loss of data associated with that functionality. We also reserve the right to remove or reject any content submitted or posted by You without cause or notice to You, at any time at Our sole discretion.

Posted Content and Moderation

You are responsible for all content posted within the Ctuit Community. Ctuit or any third-party affiliates do not control any content posted by You or other community members, and assume no responsibility for it. Any content provided to You within the Ctuit Community is provided on an “As-Is” basis without warranties of any kind.

Ctuit reserves the right to moderate the activity on the Ctuit Community and may remove any content for any reason, including, but not limited to, content that in Ctuit’s sole discretion is deemed to have violated these Terms of Use or any other referenced policies set forth in this agreement, at any time, without notification to You.

Ctuit Community Usage Analysis

Ctuit may track and analyze Your use of the Ctuit Community. This includes, but is not limited to, submitted content, which may be monitored for the purposes of helping Us to improve both the Ctuit Community and member experience in using the Ctuit Community. We may disclose such data about Your use of the Ctuit Community to third-parties to assist Us in such tracking and analysis, or where required by law.

Proprietary Rights and Privacy

By accessing the Ctuit Community, you grant Us a perpetual, worldwide right and license to use, copy, publish, republish, distribute, and create derivative works based on, in any form, any content or material You contribute to the Ctuit Community. Subject to the limited rights expressly granted hereunder, We reserve all rights, title, and interest in and to all intellectual property rights in the Ctuit Community, including but not limited to its user interface, branding, content, ideas, and underlying technology. No rights are granted to You hereunder, other than as expressly set forth herein.

By accessing the Ctuit Community, You agree that We may use Your email address to send event information, updates, and survey information.

Subject to the above, We will treat Your personal information submitted in the Ctuit Community in accordance with Section 7 Confidentiality of Our “Subscription Agreement”.

Your Representations and Warranties

You represent that: (i) Your participation and posted content in the Ctuit Community will not conflict with any of Your existing agreements or arrangements, (ii) You have sufficient rights to share all Your content with Us for Our use and with other users of the Ctuit Community, and (iii) that Your content does not violate or constitute the infringement of any intellectual property right, right of privacy, right of publicity, or other proprietary right.
